City Refines Marijuana and Agricultural Regulations June 06, 2019
After public hearings on May 21 and June 4, 2019, Coos Bay City Council authorized regulations refining the City’s standards and requirements for marijuana businesses and outdoor growing of agricultural products.
With these regulations, agricultural crops, excluding marijuana, can be considered by the City for growing outdoors in industrial areas. Marijuana indoor sales in commercial areas along with the processing and growing in industrial areas can be permitted. However, there are standards and requirements for the location of marijuana businesses, outdoor storage, compliance with site plan review, and specification of design criteria for processing and production facilities. Additional new regulations include:
- Appropriate disposal areas
- Limitations on light and glare
- Compliance with the Building Code
- Waiver for property owner claims against the City
The regulations also limit the size of floor area for marijuana production to 5,000 square feet, establishes a 1,000-foot distance between marijuana business locations and a prohibition on marijuana drive-up facilities. State of Oregon regulations and licensing will continue to be required.
